Affiliate Agreement

This Affiliate Agreement ("Agreement") governs your participation in the Kids Club by Oh Gloria Affiliate Program ("the Program"). By signing up for the Program, you agree to comply with this Agreement.

1. Membership Requirement: To become and remain an affiliate in the Program, you must be a member of the Kids Club by Oh Gloria. Your affiliate link will only be active as long as you maintain your membership in the Kids Club.

2. Commission Payout: Commission payouts will be made monthly within the first week of every month for the previous month's commission. Payouts are contingent upon the verification of payments made by customers referred by you. If referred customers are behind on payments or cancel their membership during the previous month and have not paid, you will not receive commission payments for those referrals.

3. Ownership and Disclosure: You cannot claim ownership of the Kids Club by Oh Gloria or the Program. As an affiliate, you must clearly disclose your affiliation with the Program when promoting it to others.

4. Compliance with Laws: Affiliates must comply with all applicable laws, regulations, and guidelines, including but not limited to those related to marketing, advertising, and privacy. Affiliates are responsible for ensuring compliance with the laws and regulations of their respective jurisdictions. By participating in the Program, you agree to abide by the laws of your country or region regarding marketing, advertising, and affiliate programs.

5. Prohibited Activities: Affiliates are prohibited from engaging in any activities that may harm the reputation or integrity of Kids Club by Oh Gloria, including but not limited to:

   • Spamming
   • Misrepresentation of the Program or its products/services
   • Engaging in fraudulent or deceptive practices

6. Tracking and Measurement: Affiliates' performance and commission calculations will be tracked and measured using the tracking system provided by Kids Club by Oh Gloria, which is integrated into the Kajabi website. Affiliates must ensure that their referral links are properly tracked by using the provided tracking methods. Kids Club by Oh Gloria reserves the right to rely on its tracking system for all measurement and calculation purposes related to affiliate commissions.

7. Termination: Kids Club by Oh Gloria reserves the right to terminate any affiliate's participation in the Program at any time for violation of this Agreement or for any other reason deemed appropriate by Kids Club by Oh Gloria. If you do not continue to hold a membership with Kids Club and either you or we cancel your membership, you will no longer receive commission on your referred customers.

8. Modification of Agreement: Kids Club by Oh Gloria reserves the right to modify this Agreement at any time without prior notice. Affiliates are responsible for regularly reviewing the Agreement for any updates or changes.

9. Limitation of Liability: Kids Club by Oh Gloria shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your participation in the Program.

10. Indemnification: You agree to indemnify and hold harmless Kids Club by Oh Gloria, its affiliates, officers, directors, employees, agents, and representatives from and against any and all claims, damages, liabilities, costs, and expenses (including attorneys' fees) arising out of or in connection with your participation in the Program.

11. Intellectual Property Rights: All intellectual property rights related to the Kids Club by Oh Gloria, including but not limited to trademarks, copyrights, and proprietary materials, shall remain the sole property of Kids Club by Oh Gloria. Affiliates are granted a limited, non-exclusive, non-transferable license to use the provided marketing materials solely for the purpose of promoting the Program. Affiliates agree not to use the Kids Club by Oh Gloria intellectual property in any manner that may infringe upon or dilute the rights of Kids Club by Oh Gloria.

12. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of [Your Country]. Affiliates are responsible for ensuring compliance with the laws and regulations of their respective jurisdictions. By participating in the Program, you agree to abide by the laws of your country or region regarding marketing, advertising, and affiliate programs.

By signing up for the Kids Club by Oh Gloria Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
